RED WHITE AND BREW TRIPS, LLC TRIP AND TOUR AGREEMENT
|A. DEPOSIT: The initial deposit for trips with Red White and Brew Trips, LLC (the Company), is $50 or 50% of the total trip price, whichever is greater. Full payment is due 7 days prior to departure, unless waived by the Company in advance.
B. IDENTIFICATION: Each applicant MUST HAVE AN UP-TO-DATE PICTURE ID AND/OR PASSPORT for presentation if required. No Refunds will be made to any passengers whose participation is affected due to failure to possess proper identification. Only those participants of legal age will be allowed to consume alcoholic beverages. There will be a “non-drinker” cost for those under age or who will not drink.
C. CANCELLATION AND/OR CHARGES: The Company reserves the right to withdraw the tour, to refuse to accept or retain any person as a member of the tour at any time, or make changes in the published itinerary whenever in its sole judgment conditions warrant prior to departure time. The Company may add supplemental cost such as but not limited to fuel surcharges, taxes, and currency exchange rate and other changes in prices by its vendors prior to departure.
D. RESPONSIBILITY: The Company is acting as agent for the applicant and shall not be liable for any loss of or damage to baggage or property, for any loss, injury, personal injury, death, accident, delay, inconvenience, or any other loss during, or occasioned by applicant’s participation or lack of participation, in any trip or tour. The applicant assumes any and all risks during the trip.
E. REFUNDS: A full refund will be made to applicant if the trip is canceled by the Company except and unless where such cancellation is necessitated or caused, either wholly or in part, by applicant’s cancellation or failure to make timely payments. Failure to make timely payments may be deemed cancellation.
1. Where applicant “cancels” at any time and where the trip or tour departs with 100% capacity (“filled”) applicant SHALL be entitled to a full refund less a $ 25.00 service charge and any costs incurred by the Company because of the cancellation.
2. Where applicant “cancels” thirty (30) days or more prior to departure, and where the trip or tour departs with less than 100% capacity (“Unfilled”), and where applicant provides and secures an eligible individual who completes applicant’s Trip or Tour Agreement (“Replacement”), then applicant SHALL be entitled to a full refund, less a $25.00 service charge and any cost incurred by the Company because of the cancellation and change.
3. Where applicant “cancels” less than 30 days prior to departure, and where the trip or tour departs “unfilled”, and where applicant has not provided and secured a “replacement”, then applicant will FORFEIT INITIAL DEPOSIT (SEE SECTION A), be charged a $25.00 service fee, and ANY AMOUNTS EXPENDED, PAID, or INCURRED BY THE COMPANY AS A RESULT OF THE “CANCELLATION” INCLUDING FEES, TRANSPORTATION COSTS, MEALS, LODGING, OR OTHER COSTS.
4. Regardless of when reservations are made, an applicant may cancel only by email, sent to firstname.lastname@example.org. Cancellation shall be considered effective upon applicant’s receipt of a return email. Applicant shall be liable to the Company for any monies expended or paid by the Company over and above payments made by applicant to the Company.
F. CONDUCT DETRIMENTAL TO THE COMPANY: Participant shall behave with decorum, and, if participant’s behavior is perceived to be detrimental to the Company, participant may be removed from the trip and shall bear the responsibility of returning home. Participant may also be prohibited from participating in future Company trips.
G. PAYMENT LIABILITY: The Company uses a third party payment processor for credit and debit card payments, and is not liable for damages due to the actions of this processor. At its discretion, the Company may refund amounts remitted to this processor and cancel future liabilities of an applicant, minus costs expended, paid, or incurred by the Company.
H. LIKENESS: Applicant acknowledges that photographs may be taken of trip participants and consents to the use of these photographs in Company promotional materials unless consent is withdrawn in writing.
